Because of the inherent complexities of agency relations today, SAG has received numerous requests to clarify the current state of affairs with respect to its franchised agents in Hawaii.
Pursuant to the Rules and Regulations Section of the SAG Constitution, as it is currently being interpreted by the SAG National Board, Guild members in Hawaii who wish the protection of Screen Actors Guild in their relationships with their agents are required to choose from the many SAG franchised agents in that market. Except under very limited circumstances, representational relationships with non-franchised agents in Hawaii do not comply with SAG Constitutional requirements. This precaution is necessary in order to ensure that our members' rights are fully protected in their relationships with their agents. Franchised agents (as well as the SAG members they represent) are protected by, and bound to, the terms and conditions of Rule 16(g), a/k/a the SAG Agency Regulations. Agents in Hawaii who are not franchised are outside SAG's jurisdiction, and our members should be careful not to place themselves in violation of SAG rules by deciding to work with such agencies.
