FIRST PAGE

First Line:
Print or type city and state where contract was executed.

Second Line:
Print or type full name of agency and agency identification code number.

Third Line:
“Actor” – print or type name of client as listed in the membership files of SAG. If necessary, you can call the Agency Department to
verify the performer’s name. Print or type social security number of the client. If client does not have a social security number: Please print or write ______ (name of country) citizen.

Term:
Print or type length of time the contract will be in effect. Initial contract cannot exceed one (1) year: Renewal cannot exceed three (3) years.

Commencement Date:
Print or type the day, month and year the contract will begin. Please note that no agency contract may be dated other than the date of its execution by the performer.

Percentage:
Print or type percentage (not to exceed 10%)

Actor:
Actor must sign. Name must match membership files of SAG (professional name) as on the first page of contract.

MINORS (UNDER 18)
Where minor is capable of signing, signature should be accompanied by Parent or legal guardian signature. If parent, state relationship to minor; Legal guardian must file a copy of guardianship papers along with contract.

AKA/PKA (Also Known As/Professionally Known As)
Actor must sign both with legal name and the AKA/PKA.

POWER OF ATTORNEY:
Actor does not sign; person with power of attorney signs with a copy of said document accompanying the contract.

FSO or Loan Out Corp:
(For Services of)

Actor signs his/her name as indicated on the first page of contract.

Agent:
Print or type name of agency. Agent or authorized representative must sign name. (The agency must file with SAG a list of such authorized representatives, and only such persons on the most current list shall have the authority to sign for the agent).

WAIVERS:

Late Filing:
Contracts must be received by SAG within 15 days from the date of execution (including weekend and holidays) if the agency is located in California and 30 days if the Agency is located outside of California. If received late, a request for waiver of late filing must be submitted in duplicate on the agency letterhead giving the reason for delay in filing, and signed by both the actor and the agency. (Performer’s signature is required if contract is more than 30 days late). A self-addressed stamped envelope must be enclosed for return of confirmation of waiver being granted.

Continuity of Management:
A waiver is needed after a contract has expired for a period of eight (8) months or more, and the renewal contract is for more than one year. The continuity waiver must be submitted in duplicate stating that you have been continually representing the actor since the expiration of previous contract and the execution of the new one. The request should also set for what, if any, employment was done or negotiated, and must be signed by both the actor and the agency. A self-addressed stamped envelope must be enclosed for return of confirmation of waiver being granted.

Oral Waiver:
A waiver is needed if the initial signing is after a prior oral contract relationship of a year or longer which must be verified by a written statement executed by the actor and agent accompanying the three (3) year renewal when filed with SAG.

AFTRA Contract Executing Instructions

LOCATION: The first line on the contract is to indicate the location where the contract is actually signed.  “This agreement made and entered into at ________ . . .  “   It is sufficient to put the name of the city (i.e. Los Angeles or New York).

The second line is for the name of the AGENCY not the specific sub-agent working with the performer

The third line is for the name of the ARTIST.  Artist’s name must be typed or printed clearly.  Please include any AKA’s that the Artist may use.  If Artist is a SAG-AFTRA member, their name should appear on the contract as it appears in SAG-AFTRA’s Membership files.  If they are using a different name from their SAG-AFTRA Membership listing, they should notify the SAG-AFTRA Membership Department of the name they are now using professionally.  If client does not have a social security number: Please print or write ______ (name of country) citizen

Term of Contract: Print clearly or type the term of the agreement.  The first time an Artist is signed to an AFTRA contract with an agency, the contract term may not be for more than 18 months.  It may be less than 18 months, but not more.  Contracts may be renewed for up to a maximum of three years.

Commencement date: Print clearly or type the day, month and year the contract will begin or “commence”.

Percentage: Print or type percentage (not to exceed 10%).

PARAGRAPHS 7 & 8: The names listed in these paragraphs are sub-agents employed by talent agents franchised in AFTRA’s jurisdiction. Each paragraph must list at least one name, and not more than four.  The names may be typed or printed clearly. It is not necessary for the names to be written in by the Artist, nor to be initialed by the Artist or Agent.

Paragraph 10(h) of the contract is the area to list where the Agency maintains an office that will handle this agency contract.   

Execution Date “IN WITNESS WHEREOF”:  The Execution Date of a contract (date on the last page) must be the date the contract is actually signed.  It may or may not be the same date as the Commencement Date, which is on the first page.    

Important Information:

  • If you submit a contract to the Agency Department in an attempt to renew an already existing agency contract that is still in effect and on file, the “renewal” contract may only be submitted within the last third of the term of the existing contract, for instance, within the last year of a current three year contract, or within the last four months of a current one year contract.
  • Each AFTRA Agency contract must be signed in triplicate, of which one original copy is to be given promptly to the Artist, one is to be retained by the Agency, and one is to be sent to SAG-AFTRA within thirty (30) days from the commencement date (the date on the back of the contract) if filed to the main office in New York City.  If there is a local SAG-AFTRA office in the city where the agency is doing business, the contract should be filed at that office within fifteen (15) days from the date of execution.
  • LATE FILING: If a contract is received by AFTRA after the requisite number of filing days, it must be accompanied by a Late Waiver letter stating why the contract is being filed late.  If a contract is returned to an Agency by AFTRA because it is incorrect or incomplete, it must still be re-filed within the fifteen day limit, or must have a Late Waiver attached when it is re-submitted.
  • CHANGES:  All changes, additions or deletions to AFTRA contracts must be initialed by the Artist and be in compliance with Rule 12-C.
  • ADDRESS:  AFTRA has many different departments.  When sending contracts or check authorizations to AFTRA, address the envelope to the attention of the Agency Department
